SECTION 1: OVERVIEW
This website is operated by Maison Amarella Ltd. Throughout the site, the terms "we", "us" and "our" refer to Maison
Amarella Ltd. and its subsidiaries, employees, officers, agents, affiliates or assigned parties.
The terms "you", "their" and "he/she" refer to the customer of Maison Amarella Ltd and the user of our site. "Website" or "site" refers to www.maisonamarella.com
You may not use the site and may not accept these Terms if (a) you are under eighteen (18) years of age, or (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the site under the laws of the country in which you are a resident or from which you access or use the site.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"). These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
SECTION 2: INTELLECTUAL PROPERTY RIGHT
The content of the site including, in particular, but not limited to, text, comments, illustrations, photographs and images reproduced on the site, is the exclusive property of Maison Amarella Ltd and is protected by intellectual property rights. Any full or partial reproduction of the site is strictly forbidden, unless authorised in writing beforehand by Maison Amarella Ltd. Any infringement of our brands and the integrity of our products could justify the introduction of civil or criminal proceedings.
SECTION 3: PRODUCTS
The products offered to the customer are those which appear in the catalogue published on the website within the limits of available stocks and subject to the proper functioning of the site or the mobile application.
Each product is accompanied by a photograph and a description established by Maison Amarella Ltd. The descriptions are intended to present the customer with the essential characteristics of the products before the final order is taken and cannot in any way engage the responsibility of Maison Amarella LTD. The photographs of the products are provided for information only, and are not contractual.
Maison Amarella takes great care to ensure the quality of the products offered for sale on the site. The products are stored in optimum conditions and are prepared and packaged according to strict quality standards..
3.2. Specific Conditions for Macarons
For optimal results, our macarons should be kept in a cool, dark place for no longer than four days from the preparation of the box of macaroons, whose date is shown on a leaflet issued with the box of macarons. Macarons shipped to the your home are delivered in specific packaging that protects the food from all damages during transport. We no longer guarantee the freshness of our macarons collected by the recipient more than 72 hours after their date of departure from our logistics centre. Please ensure that the macarons are kept in the refrigerator once received, Do not freeze the macarons.
3.3. Allergy Warning
The food products sold on our site contain certain allergens specified for each product in the "Allergies" section. Nutritional information for pre-packaged food products (e.g.: chocolate, delicatessen products) is also given on the product sheets in the "Nutrition Declaration" section. 3.4. Product Availability
Products sold on our site are offered within the limits of available stocks. If a product becomes unavailable, we will, as soon as possible, remove it from the catalogue of products available for our customers.
Maison Amarella reserves the right to change its offer and its range of products at any time. We agree to honour orders received on the site only within the limit of stocks availability. Exceptionally, a product shown as available on the site could be unavailable after final registration of the order. If the product is unavailable, We will inform you by email that your order has been cancelled and will reimburse you within a period of thirty (30) days, unless you expressly wish to change your order with another product recommended by us.
SECTION 4: ORDERS
We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic
region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the
quantities of any products or services that we offer. All descriptions of products or product pricing are subject to
change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at
Customers can navigate our site and familiarise themselves with the various products online with no obligation to buy or register. However, certain promotional offers or discounts may be reserved for account holders on the site and they may need to log in using their username and password to view them.
You confirm that the information provided to us is genuine, accurate and up-to-date. You can update your data at any
time in your customer account. All information provided by the customer remains under his\her sole responsibility.
You must choose a username and a password to access your account, which you should not share with anyone. Maison
Amarella will not be liable for any loss or damage that occurs due to failure to protect your login or password. If
you forget the password, a new one can be obtained by clicking on the "Forgot password" link. You will receive an
email inviting you to choose a new one under the conditions indicated.
To place an order, the process is as follows:
At each stage of the process and before its validated, you have the option to correct or change your choices. The information provided by you when placing the order is binding: if you make an error when entering your contact details or those of the recipient or the place of delivery, in particular, last name, first name, address, telephone number, email address, door code or floor, with the consequence that the products are lost, you will be liable for payment of the lost products and no compensation or refund will be granted. Before validating payment of the order, it is, therefore, your responsibility to check the accuracy of the order and make any changes required.
Once the order is placed, you will see a confirmation message on your screen and you will also receive an email to the same address linked with your account, the email will include all the details of your order.
SECTION 5: ONLINE PAYMENT
Customers can pay for orders by bank card (Visa, MasterCard, American Express), PayPal, or via the secure interface provided by the bank CIC. If payment is made by bank card, you must fill in the following information: Name of the cardholder, card number, expiry date and the three-digit security code located on the back of your card. Payment by means other than those listed above is not accepted.
Orders acknowledged by Maison Amarella are subject to payment. For payments by bank card, the payment will be acknowledged once the confirmation has been issued by the bank that issued the bank card used for payment. For payment by PayPal, the payment will be acknowledged as soon as PayPal confirms that there are sufficient funds in the account.
For payments greater than one hundred Euro ($100) or equivalent to other currencies, Maison Amarella may request proof of identification and a copy of the card used for payment in order to combat fraud. Once the order has been confirmed and the payment is made, you shall receive an order confirmation by email. This email summarises the characteristics of the order (products ordered, price, requested delivery date, etc.). You are advised to print and/or keep a copy of this order confirmation for his records.
SECTION 6: SHIPPING
We, at Maison Amarella, take extra measures to ensure that our products are safe and fresh during transportation. Since we are sending sensitive food products, we always ship in temperature-controlled packaging to ensure that our products stay cold throughout transportation. For deliveries longer than one day, we might include a cooling system, such as ice packs, along with our products to ensure cool temperature inside the package. The icepacks do not release water when they thaw and can be used in cardboard boxes and most importantly are environment-friendly, reusable and can be disposed ecologically, they are harmless and non-toxic and will not affect the products in anyway.
We do not have our own delivery service, therefore we have partnered with trusted local and international couriers to ensure that you receive your order fast and safe. We deliver all orders within a 24-48 hours window. For next day delivery all orders should be placed before 9am. Maison Amarella is not liable for any delay due to the delivery service. If you encountered any issues or delay in your shipping or have not received your order on time please send us an email to email@example.com.
We deliver from Monday to Friday only. Any order placed on Friday after 9am will be shipped on Monday.
Any costs and fees linked to taxes and customs for international transport are to be borne by the Customer.
SECTION 7: WARRANTY
Maison Amarella guarantees that the products are produced, packaged and stored in accordance with rules and regulations applied in Switzerland.
However, we cannot extend the warranty on our products if the storage conditions were not applied, or if our products were consumed beyond the expiration date indicated on the packaging.
SECTION 8: REFUND POLICY
Due to the perishable nature of our products, Maison Amarella does not accept returns.There are no returns or exchanges. Should you not be satisfied with our products and depending on the circumstances, Maison Amarella will issue a credit or provide a replacement. If for any reason you are not satisfied with your purchase, please contact our Customer Service Team WITHIN 2 DAYS of receiving your order and provide a photo with detailed description of the issue. Your satisfaction is our upmost priority and we will sure to find a solution. Due to the perishable nature of our product, all claims submitted after the 48 hours delivery window or without proper photo or order number will not be eligible for return, refund or reship.
SECTION 9: ACCOUNT DELETION
You may suspend or close your account at any time, for any reason whatsoever, by sending a request to Maison Amarella
at the following email address firstname.lastname@example.org. This deletion will take effect after the expiry of the
cancellation and withdrawal periods for the last order placed by you.
If you delete your account, you can no longer place orders via our site, you will be required to create a new account.
SECTION 10: USE OF THE PLATFORM
When registering on our site, you undertake to provide true, accurate, up-to-date and complete information on your
identity and the contact details you are providing. The use of aliases is strictly forbidden. If the Customer learns
of one or more situations that constitute impersonation, he must immediately notify Maison Amarella using the
following address: email@example.com.
A customer may only create one account on the Website, which is limited to his personal use.
You are alone responsible for the use of your account and for the protection of your username and password. Any impersonation, loss, misappropriation or unauthorised use of a customer's user names and/or account, and the consequences thereof, are the sole responsibility of this customer. In all of the cases mentioned above, the customer is required to immediately notify Maison Amarella, by email, giving his full name, postcode, town, date of birth, telephone number, the email address used for his account and, if possible, his old password, at the address firstname.lastname@example.org, to enable us to take measures to remedy the situation, and in particular to immediately cancel and/or update the username in question and/or the password in question. Abuse of this reporting facility is likely to give rise to the liability of the person abusing it.
You undertake to take all of the measures necessary and useful for protecting and securing your equipment, username and password, in particular by never communicating your username and password to third parties or leaving them accessible.
Customers recognise that their access to the site may depend on certain technical requirements. In particular, Customers must therefore have a broadband internet connection and an up-to-date browser. Otherwise, we cannot be held responsible for any difficulties encountered when using the site.
You should be aware that due to the nature of technology, systems or technological failure may impede or prevent access to all or any part of the data.
